Terms of business

As each assignment is different, our pricing is very flexible, reflecting the individual project. We will gladly provide you with an estimate. Please contact us by telephone or e-mail.

Unless otherwise agreed, all our services are provided subject to our Standard Terms of Business:

Copyright of material to be translated and translation rights
Any assignments from the Client are accepted on the understanding that carrying out the task will not infringe any third party rights.

The Client undertakes to keep English Texts + Translations safe from any claim whatsoever for infringement of copyright and/or other intellectual property rights. The Client also undertakes to keep English Texts + Translations safe from any legal action including defamation which may arise as a result of the contents of the original document or its translation.

Quotations
Quotations given are based on the Client's description of the content, the estimated volume of the material to be translated and any instructions given by the Client.

Any quotation by English Texts + Translations based on the Client's description of the assignment may be subject to a new agreement between the parties if, on seeing the material, English Texts + Translations regard the description as inaccurate.

Estimates are not contractually binding, but provide a guide only. Subject to the second paragraph of this section, a binding quotation given after all material has been seen by English Texts + Translations will remain valid for a period of 30 days from the date on which it was given.

Fees
All fees quoted are exclusive of VAT.

All fees quoted include delivery by e-mail or 1st class post. Any other delivery arrangements will be charged at cost.

We are one of the exceptions to the translating rule: we have no minimum charge.

We make no charge for express translations.

Fee basis
Translations are charged per line of 55 keystrokes of translated text. All names, addresses, numbers etc. are deducted, provided that the original documentation is delivered in electronic form. A maximum price will be quoted in advance. A fixed price can also be agreed if requested.

All other services, such as slogans, media reports in English, speeches in English, or proofreading of existing texts are charged at an hourly rate.

Supplementary fees
Supplementary charges may be levied at the discretion of English Texts + Translations for reasons which may include, but are not limited to, the following:

- complicated layout or other forms of layout for presentation requiring additional time or resources

- unusually highly specialist areas - copy of poor legibility - terminological research - certification

The level of any such charges will be agreed in advance.

Amendments
If amendments or additions are made to an assignment during its progress, fees, supplementary charges and terms of delivery will be adjusted accordingly.

Commissioning
All assignments are to be commissioned in writing either by post or e-mail.

Delivery of translation assignments
Delivery dates agreed with the Client will only become binding following sight of the material to be translated and complete instructions have been received from the Client. The delivery date will be confirmed in writing either by post or e-mail.

Unless otherwise agreed, the translation will be delivered by e-mail to the address indicated by the client. The deadline shall normally be 17.00 hrs local time on the agreed delivery date. A translation will be deemed to have been delivered on its dispatch. English Texts + Translations cannot be held liable for loss of a translation after its dispatch. If a client does not receive a translation by the agreed delivery date, it is the client’s responsibility to advise English Texts + Translations of non-receipt.

Texts for publication
Following delivery of a translation, English Texts + Translations reserves the right to request to proof-read its translations prior to publication. Corrections or improvements will be made free of charge. However, correction errors or unauthorised amendments etc. will be charged on an hourly basis.

Termination and cancellation of assignments
If an assignment is commissioned and subsequently cancelled, the Client will be liable for payment of any work already completed before cancellation.

Copyright
English Texts + Translations will normally retain unrestricted, exclusive usage rights of any translation work produced. If required, copyright may be transferred to the client upon payment of an agreed fee.

Discretion
All confidential information disclosed to English Texts + Translations, by the Client will be treated as confidential and will not be disclosed to any third party (unless required by law).

However, English Texts + Translations holds the right to consult third parties regarding translation terminology provided that there is no disclosure of confidential material.

The Client is regarded as the main point of contact for provision of background information which may be required to complete the translation.

English Texts + Translations will, if required, return to the client all documentation pertaining to an assignment, following payment of the assignment. English Texts + Translations reserve the right to retain any terminology arising from the assignment for future use.

Payment
Payment is due within 30 days of the invoice date.

Partial payment may be requested for larger assignments on terms to be agreed.

Where an interim payment for a larger assignment is overdue, English Texts + Translations retain the right to stop work on the assignment in hand until the outstanding payment is made.

Complaints and disputes
The translation supplied will be deemed to have been accepted if no complaints have been raised within 14 days following delivery. Complaints received after this period will have no validity.

Should translation errors be discovered, English Texts + Translations will make corrections free of charge and within a reasonable timescale. Clients not wishing corrections to be made, shall not be entitled to refuse payment or make any reduction in fees. Should the client fail to give English Texts + Translations the opportunity of making corrections, the client shall not be entitled to claim compensation of any kind.

If the parties cannot resolve a dispute amicably, or if either party refuses to accept arbitration, the parties will be subject to jurisdiction under Swiss law. The place of jurisdiction is Interlaken.

Responsibility and liability
English Texts + Translations will endeavour to fulfil assignments to the best of their ability, knowledge and belief and time and expenses permitting, consult all known sources of information.

Unless specified otherwise, translations will be deemed to be of "draft" quality.

English Texts + Translations cannot be held liable for the loss of any documents supplied by or to the client due to theft, fire, water, storm, force majeure, hacking or loss in mail, either traditional or electronic.

The liability of English Texts + Translations, on any grounds whatsoever, is limited to the invoice value of the work involved. Consequential damages and liability are expressly excluded
